Affidavit of Translation
(Federal)

This template is an affidavit of translation that may be used in a federal district court case to certify the accuracy of a translation of evidence. The template includes drafting notes and optional and alternate clauses. Documents or written testimony that are not in English must be translated before being submitted to a federal court. United States v. Rivera-Rosario, 300 F.3d 1, 5 (1st Cir. 2002); see also 48 U.S.C. § 864. Some courts require these translations to be certified in order to be admissible. See, e.g., D.P.R. Civ. R. 5(g). To accomplish this, you must accompany the translation with an affidavit or declaration of translation in which the translator certifies their competence to translate the document and certifies that the translation is true and correct. See, e.g., Kasper Glob. Collection & Brokers, Inc. v. Glob. Cabinets & Furniture Mfrs. Inc., 952 F. Supp. 2d 542, 555 n.9 (S.D.N.Y. 2013). For more about affidavits and declarations generally, see Moore's Federal Practice - Civil § 56.94. For a template declaration. see Declaration (Federal).
